In addition to our Terms of Services, Winvictory Developers Pvt. Ltd. (“Company”) respects your privacy and is committed to protecting it. The Company is engaged in the business of providing online digital platform, hereinafter referred to as “Learnoper”, for live, recorded or in any other way on subscription basis class/session to its users (“Users”). This Privacy Policy (the “Policy”) explains the types of information collected by the Company when you use the Platform (www.learnoper.com).

For ease of reference, use of the terms “the Company”, “Learnoper”, “we”, “us, and/or” refer to Winvictory Developers Private Limited – a company incorporated in India and all of its affiliates which have license to host the Platform and offer Services. Similarly, use of the terms “you”, “yours” and/or “User(s)” refers to all users of the Platform and includes all Users, whether free or paid subscribers (as more particularly defined under our “Terms and conditions”.

The Company is concerned and committed to protecting and maintaining the privacy of all its Users and has published this privacy policy statement (the “Privacy Policy” or “PP”) to familiarize you with the manner in which the Company collects, stores, uses, discloses, alters, and/or deletes Your Personally Identifiable Information (“PII”) collected during your usage of Learnoper. Any capitalized terms used but not defined in this PP shall have the meaning ascribed to such term in the Terms of Services.

This Privacy Policy statement shall apply to all Users who visit and access Learnoper website and mobile application (collectively referred to as “Website”). The users unconditionally agree that browsing the Website and/or using its services signifies their unconditional assent to this Privacy Policy.

We respect the privacy of its users and are committed to protect it in all respects. Any dispute with Learnoper over privacy matters are subject to this Privacy Policy read in conjunction with the Terms of Services.

A. Purpose

  • Applicable laws, including with respect to maintaining appropriate data protection and privacy. The purpose of this PP is to ensure that:
  1. Users are aware of and have complete control over what PII you provide to the Company, and how the same is being used by the Company while providing You with Our Platform and services.
  2. You are at all times aware of the rights available to You with respect to Your PII.
  3. The information provided by Users on the Platform is processed, stored, and used in accordance with the Information Technology Act, 2000.
  4. The Company presumes adequate and lawful parental consent in case the Personal Information is shared by a user under the age of 18 years.
  • The Company insists upon the highest standards for securing Customer data and maintaining customer information privacy.

B. Subscription or Paid Service Information

  • When the User chooses any subscription or paid service provided as part of the Company Services, the Company’s payment gateway provider may collect your transaction, address or billing information, including your credit card number and expiration date etc.

C. Information Company Collect

  • The Company has already specified (in Terms of Services) the kind of information (PII and otherwise) that the Company requires, collect, access, and store during the user’s usage of Learnoper. Further, the Company has also clarified that it is necessary and mandatory for the Company to be able to collect/store all of this information for the User to be able to use Learnoper and its basic features.
  • Cookies: Cookies are pieces of information that are stored on the User’s computer when the User accesses the Platform. The Platform may use temporary cookies to help the User access some of the special functions within the database driven areas of the Platform. Once the User leaves the Platform, these cookies expire. Cookies do not collect personal identifying information about the User.

  1. Strictly Necessary Cookies – These cookies are needed to run our website, to keep it secure and to comply with regulations that apply to us.

D. Information Storage and Security

  • All the information that the Company collects from the User during the User usage of Learnoper is stored on  servers, located in India. The company will access the information on the cloud. The Company’s service provider for server uses globally accepted standards for ensuring and maintaining the protection, security, confidentiality, and privacy of all data on its servers.
  • The Company works hard to protect the User from unauthorized access to or unauthorized alteration, disclosure or destruction of any information the Company holds. Pursuant to the same, the Company have implemented globally accepted standards and procedures to maintain ongoing data protection and privacy by ensuring the following:
  1. The encryption of the Company’s services and all PII using secure server software, which is among the best software available today for secure transactions.
  2. The constant review of the Company information collection, storage and processing practices, including the Terms of Services & Privacy Policy, and the physical security measures to guard against unauthorized access to systems;
  3. The constant upgradation and/or alteration of the Company’s policies as may be necessary to ensure the ongoing confidentiality, protection, privacy, security, and accessibility of all data and systems;
  4. Limiting the disclosure of PII to the Company’s employees, independent contractors including vendors, affiliates, consultants, business associates, service providers and distributors of the Company’s services, only on a “need-to-know” basis, and only if the disclosure will enable that person/entity to provide the Company with business, professional, or technical support or fulfil the User’s request and requirements under the services.

E. Recording

  • The Company reserve the right and the User expressly consent to the Company recording the classes, discussions, processes, events, conversations, feedback, pertaining to courses/sessions, offered online or any other format. Please visit our “Terms of Services” for more details.

F. Rights Available to the User

  • Once the User start using the Platform, the User will have the right, at any time, to require the Company to do any of the following with respect to the User’s PII if the same has been shared with the Company:
  1. Delete/erase all PII pertaining to the User that the Company may have on the Company’s systems, logs, servers or any other medium. This provision will not apply to any data or PII that the Company may need to retain pursuant to any applicable law or any request/requirement of a public/government body, whether in the User’s country of residence or not;
  2. Rectify, modify, or alter any of the User’s PII, if the User has identified any mistake, error or inaccuracy in the same. This also covers situations where, for example, the User has started using a new/different email account.
  3. Export and provide the User with a copy of all of the User’s data, including the User’s PII, that the Company may have on its servers.

G. Change in Privacy Policy

  • The User acknowledges that the User has read this PP carefully and has fully understood how the Company treats the User’s PII, by providing its input on the I agree option the User assent to this Privacy Policy. In the event there are any changes to this PP or in the way the Company treats the User’s PII, the Company shall intimate the User of the same via email prior to the enforcement of such change. The Company will also display a notice on the Platform regarding the above. If after the User receives a notice of change to the Terms of Services or PP the User does not object to the same and/or continue to use Learnoper and the services, the User will be assumed to have provided its consent to the changes.

H. Choice/Opt-Out

  • As stated previously, we provide all Users with the option and choice of opting-out of receiving certain third-party services and/or the Learnoper in general, at any time.

Redressal Mechanism: Any complaints, abuse or concerns with regards to content and or comment or breach of these terms shall be immediately informed through email signed with the electronic signature to [email protected].

  1. The address, telephone number or e-mail address of the complaining party.
  2. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
  3. A statement, under penalty of perjury, that the information in the notice of copyright infringement is accurate, and that the complaining party is authorized to act on behalf of the owner of the right that is allegedly infringed.
